Contendr Terms of Use

Welcome to Contendr. These Terms of Use ("Terms") govern your access to and use of the Contendr website, applications, features, content, analytics, tools, and related services (collectively, the "Services") provided by Digital Bonsai, LLC ("Contendr," "we," "us," or "our").
By accessing or using the Services, creating an account, connecting a third-party account, importing data, or clicking to accept these Terms, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
You may be required to create an account to access certain features. You are responsible for:
maintaining the confidentiality of your login credentials
restricting access to your account
all activities that occur under your account
You agree to provide accurate information and to keep your account information current. We may suspend or terminate your account if we believe information provided is inaccurate, misleading, fraudulent, or violates these Terms.
The Services may allow you to connect third-party accounts or import league, roster, transaction, or other fantasy sports-related data. By doing so, you authorize Contendr to access, receive, store, process, analyze, display, and use that information in accordance with these Terms and our Privacy Policy.
You represent and warrant that you have all rights and authority necessary to connect such accounts or provide such data to us.
By creating an account, connecting a third-party account, importing data, uploading content, submitting information, or otherwise using the Services, you authorize Contendr to access, collect, receive, store, host, process, analyze, transmit, display, copy, adapt, modify, and otherwise use information associated with your account and use of the Services, including without limitation account identifiers, profile information, league information, roster data, transaction history, lineup activity, preferences, usage information, submissions, and other data made available by you or through your use of the Services ("User Data").
Subject to our Privacy Policy and applicable law, you grant Contendr a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use User Data for the following purposes:
(a) providing, operating, maintaining, and supporting the Services;
(b) authenticating accounts and protecting the security and integrity of the Services;
(c) personalizing features, recommendations, rankings, analyses, reports, and outputs;
(d) debugging, monitoring, troubleshooting, fraud prevention, abuse prevention, enforcement of our policies, and quality assurance;
(e) developing, testing, tuning, validating, improving, and operating analytics systems, algorithms, models, and machine learning or artificial intelligence systems used by or on behalf of Contendr;
(f) generating aggregated, statistical, benchmark, transformed, and de-identified datasets, analyses, and product insights; and
(g) any other purpose described in our Privacy Policy or otherwise disclosed to you.
You acknowledge and agree that Contendr may retain, use, and derive insights from User Data, as well as from aggregated, transformed, de-identified, or otherwise non-personal derivatives of User Data, for product development, service improvement, research, analytics, benchmarking, and model improvement purposes, to the extent permitted by applicable law.
You represent and warrant that you have all rights, permissions, and authority necessary to provide User Data to us and to grant the rights and licenses described in these Terms.
The Services, including all software, interfaces, text, graphics, visual design, analytics methodologies, scoring systems, valuation logic, rankings logic, outputs, reports, data structures, and related intellectual property rights, are and will remain the exclusive property of Contendr and its licensors.
Except for the limited right to use the Services as expressly permitted by these Terms, no rights are granted to you by implication or otherwise.
Without limiting the foregoing, Contendr retains all right, title, and interest in and to:
the Services and all improvements thereto
aggregated, statistical, benchmark, de-identified, transformed, or derivative data generated through operation of the Services
trained models, system improvements, methodologies, and learnings developed through analysis of User Data or use of the Services, subject to our obligations under the Privacy Policy and applicable law
You agree not to:
use the Services for any unlawful purpose
copy, scrape, reproduce, republish, reverse engineer, decompile, or attempt to extract source code, underlying models, or proprietary methodologies except as allowed by law
interfere with or disrupt the integrity or performance of the Services
bypass authentication, access controls, or rate limits
upload malicious code or harmful content
use the Services to infringe the rights of others
impersonate any person or entity
use automated systems to access the Services in a manner that imposes unreasonable load or circumvents intended usage restrictions
The Services may reference, integrate with, import from, or analyze information from third-party platforms, public sources, licensed sources, user-connected accounts, or other providers. Contendr is an independent product and is not affiliated with, endorsed by, sponsored by, approved by, or officially associated with Sleeper, KeepTradeCut, FantasyCalc, DynastyProcess, or any other third-party platform, publisher, data provider, fantasy sports company, or trademark owner unless expressly stated otherwise.
Third-party names, trademarks, logos, and brand references are the property of their respective owners and are used solely for identification, reference, commentary, compatibility, or descriptive purposes. Their appearance does not imply any relationship, endorsement, sponsorship, authorization, or approval.
Third-party data may change without notice, may be incomplete or inaccurate, and may be subject to outages, restrictions, delays, or removal by the applicable provider. Contendr does not control and is not responsible for the ongoing availability, accuracy, completeness, or reliability of third-party data, content, APIs, or services.
Contendr provides informational, analytical, and entertainment-oriented tools only. Rankings, valuations, recommendations, scores, archetypes, projections, comparisons, insights, and other outputs are based on our models, methodologies, assumptions, and available data, which may change over time and may not reflect real-world outcomes.
We do not guarantee the accuracy, completeness, usefulness, or performance of any output, and use of the Services is at your own risk. You remain solely responsible for your decisions, including roster, lineup, trade, draft, and league management decisions.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTENDR DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTENDR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTENDR'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CONTENDR FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Contendr and its officers, directors, employees, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
your use of the Services
your User Data
your violation of these Terms
your violation of any law or the rights of any third party
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk for us or others, or if we discontinue the Services.
You may stop using the Services at any time. Termination will not affect provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, indemnification, and dispute-related provisions.
We may modify the Services at any time. We may also update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms, updating the effective date, sending an email, or providing in-product notice. Your continued use of the Services after the changes take effect means you accept the updated Terms.
These Terms are governed by the laws of NH, without regard to conflict of laws principles.
